    1. Agreement

    1.1 These Terms and Conditions ("Terms") govern your use of the Teachers Guide website, tools, and associated digital services ("the Service"), operated by Teachers Guide Ltd ("we", "us", "our").

    1.2 By accessing or using the Service, you agree to comply with and be bound by these Terms.

    1.3 If you do not agree with any part of these Terms, you must not use the Service.

    1.4 We may amend these Terms at any time. Any changes will be effective when posted on the website, and your continued use constitutes acceptance of the revised Terms.

    2. Description of the Service

    2.1 Teachers Guide provides educators with access to digital teaching and planning tools, including AI-assisted lesson planning, marking, report writing, and other resources designed for professional educational use.

    2.2 The Service is offered under two payment models:

    • Credit Top-Up Model: Users may purchase credits to use AI-powered features on a pay-as-you-go basis. Credits are non-refundable and never expire.
    • Subscription Model: Users may subscribe to a monthly plan (currently £5/month) which includes 15 free credits per month and exclusive access to premium features such as the Custom AI Module Builder.

    2.3 We reserve the right to modify, suspend, or discontinue any feature or component of the Service at our discretion, provided that such changes do not materially reduce the value of any pre-paid credits or active subscription period.

    3. Eligibility and Accounts

    3.1 You must be at least 18 years old and employed or training within an educational setting to use the Service.

    3.2 You agree to provide accurate information during registration and to keep your login credentials confidential.

    3.3 You are responsible for all activities conducted under your account.

    3.4 If you suspect unauthorised access to your account, you must notify us immediately at admin@teachers.guide.

    3.5 We reserve the right to suspend or terminate accounts that breach these Terms, misuse the Service, or cause technical or reputational harm.

    4. Credits and Usage

    4.1 Teachers Guide Ltd operates a credit-based system for AI-powered features. Each AI generation (such as a lesson plan, report, or resource) costs a specified number of credits as determined by us.

    4.2 Credits can be purchased in packages through our top-up system. All credit purchases are final and non-refundable.

    4.3 Credits do not expire and remain in your account until used.

    4.4 Subscribers receive 15 free credits per month as part of their subscription. These credits are added automatically at the start of each billing cycle.

    4.5 Certain premium features (such as the Custom AI Module Builder) are only available to active subscribers.

    4.6 We reserve the right to adjust credit costs for individual features to reflect changes in underlying costs or to ensure fair pricing.

    4.7 We reserve the right to monitor usage patterns to maintain system integrity and prevent abuse. Accounts should NOT be shared.

    4.8 Where we detect excessive or automated use that breaches this policy, we may issue a warning, restrict access, or suspend the account pending review.

    4.9 Users who require higher usage volumes for legitimate educational purposes (e.g. department-wide access) may request a tailored plan by contacting admin@teachers.guide.

    5. Intellectual Property

    5.1 All intellectual property rights in the Service, including but not limited to software, design, branding, and content, remain the property of Teachers Guide Ltd or our licensors.

    5.2 Content created using the Service (such as lesson plans or resources) belongs to you, provided it does not infringe third-party rights.

    5.3 You grant us a limited, non-exclusive licence to use uploaded materials solely to provide the Service and improve its functionality.

    6. Payment and Subscriptions

    6.1 Credit top-ups are one-time purchases charged at the point of sale.

    6.2 Subscriptions are charged monthly in advance at the current subscription rate (£5/month at the time of writing).

    6.3 All fees are listed in GBP and exclude VAT unless otherwise stated.

    6.4 Payment is processed via our secure third-party payment provider (Stripe). We do not store credit card details on our servers.

    6.5 Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.

    6.6 Subscribers receive 15 free credits added to their account at the start of each billing cycle.

    7. Cancellations and Refunds

    7.1 You may cancel your subscription at any time via your account settings or by contacting admin@teachers.guide.

    7.2 Cancellations take effect at the end of the current billing period. You will retain access to subscriber features until the end of your paid period.

    7.3 Credit purchases are non-refundable. Credits remain in your account indefinitely and can be used even after subscription cancellation.

    7.4 We may, at our discretion, provide a pro-rata refund for subscriptions if a cancellation request is made within 14 days of the initial subscription purchase and minimal usage has occurred.

    7.5 If the Service is terminated by us due to a breach of these Terms, no refund will be issued for either credits or subscription fees.

    8. Acceptable Use

    You agree not to:

    • Use the Service for unlawful purposes or in breach of any applicable laws or regulations
    • Upload, share, or distribute harmful, offensive, defamatory, or infringing content
    • Attempt to reverse-engineer, decompile, or access restricted areas of the Service
    • Use automated scripts, bots, or other means to extract data or overload system resources
    • Share your account credentials or allow unauthorised access to your subscription

    9. Data Protection and Privacy

    9.1 We process your personal data in accordance with our Privacy Policy and applicable data protection legislation (UK GDPR and Data Protection Act 2018).

    9.2 By using the Service, you consent to the collection, use, and disclosure of your data as described in the Privacy Policy.

    10. Limitation of Liability

    10.1 The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

    10.2 We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

    10.3 To the fullest extent permitted by law, Teachers Guide Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

    10.4 Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim.

    10.5 Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by law.

    11. Indemnity

    You agree to indemnify and hold harmless Teachers Guide Ltd, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms or misuse of the Service.

    12. Third-Party Links and Services

    12.1 The Service may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third parties.

    12.2 Your use of third-party services is at your own risk and subject to their respective terms and policies.

    13. Force Majeure

    We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, cyberattacks, or failures of third-party infrastructure.

    14. Termination

    14.1 We may suspend or terminate your access to the Service immediately if you breach these Terms or engage in conduct that harms the Service or other users.

    14.2 Upon termination, your right to use the Service ceases, and we may delete your account and associated data in accordance with our data retention policy.

    15. Dispute Resolution

    15.1 If a dispute arises, we encourage you to contact us at admin@teachers.guide to seek an amicable resolution.

    15.2 If informal resolution is unsuccessful, disputes will be resolved through binding arbitration in accordance with the rules of the Chartered Institute of Arbitrators, with proceedings held in London, England.

    15.3 Nothing in this clause affects your statutory rights as a consumer.

    16. Governing Law and Jurisdiction

    16.1 These Terms are governed by and construed in accordance with the laws of England and Wales.

    16.2 Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

    17. Severability

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

    18. Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and Teachers Guide Ltd regarding your use of the Service and supersede all prior agreements and understandings.
